Colorado takes a significant step towards road safety with the signing of 'Magnus' Law,' named after 17-year-old cyclist Magnus White, who tragically lost his life nearly three years ago. This landmark legislation mandates law enforcement to offer voluntary alcohol breath tests to drivers involved in crashes that result in death or injury.
Magnus White was fatally struck by an impaired driver during a training ride near Boulder on July 30, 2023. The driver, Yeva Smilianska, was later found guilty of reckless vehicular homicide after a five-day trial. Notably, no breath test was conducted on her at the scene, raising critical questions about accountability.
Governor Jared Polis emphasizes the law's aim to prevent similar tragedies, stating it honors Magnus's legacy while enhancing public safety. The White family, who established The White Line Foundation to advocate for safer roads, expressed their frustration over the delay in justice, highlighting systemic gaps that contributed to their loss.
Sponsored by Senators Dylan Roberts and John Carson, along with Representatives Junie Joseph and Matt Soper, SB26-132 aims to protect cyclists and pedestrians across Colorado. This legislation marks a pivotal shift in legislation following a heartbreaking loss, ensuring fewer families endure the same pain as the White family.
