INEOS is seeking the return of approximately £174 million in assets, including the AC75 yacht Britannia, after alleging that Athena Racing has wrongfully refused to transfer ownership following their contractual agreement. The documents filed in the High Court of England and Wales outline that INEOS believes their entitlement stems from a Partner Agreement signed shortly after the 35th America's Cup in Bermuda, where they were eliminated in the semifinals.
At the center of the conflict is an "INEOS Option" clause, requiring INEOS to notify Athena Racing within 90 days of the 2024 America’s Cup conclusion about their future intentions. On January 13, 2025, INEOS informed Athena that they would not exercise this option and demanded the transfer of all INEOS-funded assets. However, Athena’s defense details remain undisclosed.
